Personal Data Protection Law Clarification Text

Turkey's Personal Data Protection Law No. 6698 (KVKK) was adopted on March 24, 2016, and published in the Official Gazette No. 29677 on April 7, 2016. Some parts of KVKK came into force on the date of publication, while others took effect on October 7, 2016.

As WAGONN Bilgi Teknolojileri, we prioritize the security of your personal data. Our company, established in accordance with the Constitution and Laws of the Republic of Turkey, aims to inform you, our valued customers, as the "Data Controller" defined under KVKK, about how your personal data is collected, processed, and the purposes of processing.

Personal data that you, our valued customers, have shared with our company with your explicit consent may be processed within the scope of KVKK, stored, transferred to relevant domestic and international parties affiliated with our company, used for profiling, and classified within the limits of company operations and service areas.

Collection, Processing, and Purpose of Processing Personal Data

In accordance with Turkey’s Personal Data Protection Law No. 6698 (KVKK), your personal data shared with WAGONN Bilgi Teknolojileri may be obtained, recorded, stored, modified, reorganized, and processed in various ways, either automatically or manually, as part of a data recording system. All activities performed on personal data under KVKK are considered "processing of personal data."

Personal data collected through www.wagonn.net / wagonn.net is processed to provide our products and services, to communicate with you regarding the products and services you have received or will receive, to present product/service offers, for marketing activities, and for new product development.

Recipients and Purposes of Transferred Personal Data

Our company may transfer the collected personal data to its business partners, affiliates, subcontractors, and regulatory authorities, as required by KVKK of the Republic of Turkey, within the framework of the fundamental principles stipulated by KVKK and under the conditions and purposes of personal data processing set forth in Articles 8 and 9 of KVKK. Such transfers may occur for the purposes outlined above and may involve both domestic and international recipients.

Method and Legal Basis for Collecting Personal Data

For the purposes mentioned above, your personal data may be transferred to our direct or indirect domestic/international affiliates, program partner organizations we collaborate with, domestic/international organizations, and other third parties.

Rights of Personal Data Owners Under Article 11 of KVKK

Within this scope, personal data owners have the right to:

  • Learn whether their personal data is processed,
  • Request information if their personal data has been processed,
  • Learn the purpose of processing and whether it is used in line with that purpose,
  • Know the third parties to whom their personal data is transferred, domestically or abroad,
  • Request correction of incomplete or inaccurate data and request notification of such corrections to third parties to whom the data has been transferred,
  • Request deletion or destruction of personal data when the reasons for processing no longer exist, and request notification of such actions to third parties,
  • Object to decisions made solely based on automated data processing if it produces unfavorable results,
  • Demand compensation if they suffer damages due to unlawful data processing.

According to Article 13(1) of Turkey’s Personal Data Protection Law No. 6698 (KVKK), you can submit your requests regarding the rights mentioned above in writing or via other methods determined by the Personal Data Protection Board (such as registered electronic mail (KEP), secure electronic signature, mobile signature, or via an electronic mail address previously notified to our company and recorded in our system).

Storage and Protection of Personal Data

Personal data stored in the database and systems of WAGONN Bilgi Teknolojileri will be kept confidential in accordance with Article 12 of KVKK of the Republic of Turkey. Except for legal obligations and the regulations specified in this document, personal data will not be shared with third parties.
